Worldwide Mareva Injunction

A Worldwide Mareva Injunction is an internationally binding court order, which freezes assets so that a party cannot move or manipulate them to be beyond the jurisdiction of a certain court. It is named after the case in which it was first authorised.

A Worldwide Mareva Injunction is often used to prevent a defendant from secreting assets out of a court’s jurisdiction as soon as a claim is served. Aimed usually at a specific defendant, and not attached to assets themselves, the injunction is enforced by the contempt powers of a court.

As you might imagine, Worldwide Mareva Injunctions are typically obtained without notice to the other party as tipping off the defendant may cause the movement of the relevant assets before the court can issue an injunction

Note

I write for the benefit of those who are experiencing family breakdown and for fellow family law professionals. Please note that all persons mentioned in the scenarios are fictitious: details have been deliberately changed in order to protect identities and other confidential circumstances of my clients.

Please also note the advice I give in each scenario must not be relied upon by anyone reading my blog. You must always take your own legal advice as your circumstances may be different and English family law is continually changing.
